- Personal InjuryAfter being involved in an accident, personal injury victims often have questions about what to do or the necessary steps to take to ensure that they are protected from the financial impact incurred because of their injuries. Normally they are not thinking about the importance of how case management works until they find themselves needing to bring a claim. Regretfully, this could lead to errors, or misconceptions that affect their choices and harm financial recovery.

- Property DamageThe legislature’s intent and the policy behind the elder abuse statutes are clear. Arizona has a substantial population of elderly people, and the legislature was concerned about elder abuse. In civil actions for elder abuse, pain and suffering may be the only compensable damages the victim may recover. Because incapacitated or vulnerable adults are not employed, they cannot recover damages for lost earnings or diminished earning capacity. Because incapacitated or vulnerable adults generally have Medicare, Medicaid coverage, or other insurance, they may not recover for medical expenses. Property damage is generally not an issue in elder abuse cases. As a result, the most likely form of damages recoverable in these cases are for pain and suffering. Under the Arizona statutes, damages up to two times the amount of the monetary damages may be established under either A.R.S. §46-456(A),(B) or (C).
- Workers CompensationArizona law provides benefits for survivors of persons who are killed in an accident arising out of and in the course of their employment unless the injury was purposely self-inflicted. Arizona Revised Statute Section 23-1021. Under the workers compensation statutes, however, death benefits are paid regardless of who was at fault for the accident. The survivors do not need to prove a claim for negligence. Rather, the survivors need to merely prove that the decedent employee was killed while in the course and scope of his employment.
