- DivorceDivorces can be contested or uncontested. In an uncontested divorce, the parties are able to reach agreement on all issues without the need for any hearings or additional legal process. Contested divorces can be limited to one or two minor issues or can mean that there is no agreement between the parties.
- Child SupportChild support in Georgia utilizes a shared income approach regarding child support obligations. The law recognizes both parents’ obligation to contribute to the support of a child. The following chart is an example of the basic child support obligation ("BCSO")...
- Child Custody and VisitationTypically, one party is generally considered the "primary physical custodian" and the child lives with that parent most of the time. The remaining parent, often called the "secondary physical custodian", is usually awarded liberal visitation rights. The parties can agree to almost any visitation schedule which meets their needs, but alternating weekend visitation with holiday arrangements are most common. Adjustments are made when work schedules, religious observances, physical distance, or the parties' desires require changes.
- Spousal SupportAlimony is designed to assist a party after divorce. It can be awarded to either party in accordance with the needs of the parties and ability to pay. Today, it is most commonly ordered as "rehabilitative" payments for a limited period of time. However, a party is not entitled to alimony if the cause of the separation is that party's adultery or desertion.

- EmbezzlementWhile the bankruptcy process gets rid of most debts, there are any number of debts that may not be discharged. Under certain circumstances, a creditor is required to file an adversary proceeding in the Bankruptcy Court no later than 60 days after the initially scheduled date of the meeting of creditors. (See 11 USC 523(a)(2)(false pretenses, false representations or actual fraud), 11 USC 523(a)(4)(fraud or defalcation while acting in a fiduciary capacity, embezzlement or larceny), 11 USC 523(a)(6)(willful and malicious injury)). Other debts, such as domestic support obligations (11 USC 523(a)(5)), other domestic related obligations (11 USC 523(a)(15)) or taxes (11 USC 523(a)(1)) may, but are not required, to be filed within those timelines. If you are a creditor and believe the debt may not be dischargeable, or are a debtor served with one of these adversary proceedings, consult with your attorney immediately.
