- Money LaunderingFor a broker: Successful trial defense of a wrongfully terminated broker accused by a major brokerage firm of ignoring a purported money-laundering scheme and breaching his promissory note for $807,270.88. The broker pursued counterclaims which included defamation, breach of contract, and sought expungement of his U-5. After a four day FINRA arbitration, the Panel found for the broker, dismissed the firm’s note claim in its entirety, and ordered that the U-5 be expunged based on the defamatory nature of the information.

- Property DamageBecause of DRH&R’s background in sophisticated coverage issues, we were retained to represent a major insurer in handling a large volume docket of mold litigation in Texas and Louisiana. Insurance companies had been deluged with mold claims after a verdict against Farmers put mold litigation on the map. The impact of these claims reverberated throughout the insurance industry, forcing one carrier to attempt to pull out of the Texas market and others to increase premiums. We were asked to defend these claims around the state and later Louisiana by applying more than 20 years of coverage experience combined with solid, proven trial practice. In October 2002, DRH&R obtained a significant victory in South Texas by securing a zero mold verdict against plaintiffs seeking substantial property damage and bodily injury damages. The verdict was significant as it is the first major mold case to go to trial since the verdict against Farmers. During the trial, DRH&R successfully excluded plaintiffs’ expert medical testimony for failure to establish any scientific link between mold and physical injuries. A second trial in McAllen federal court resulted in a verdict far less than the amount sought. These trial and briefing successes prompted hundreds of settlements because, as one lawyer commented, we had “changed the road map.†These results exemplify the combined coverage and trial skills we bring to all coverage disputes.

After graduation, he worked as an associate underwriter for a major medical malpractice insurance company. He decided to pursue a legal career and attended the University of Texas School of Law. At Texas Law, he served on the Juvenile Justice Clinic, the Transnational Worker Rights Clinic, and as a Research Editor at the Review of Litigation. His work on automatic exclusion, titled “Rule 37(C): The Circuit Split, Polar Opposite Goals, and the Gradient Solution,†is published in the 40th Edition of The Review of Litigation.

For 39 years, Mr. Harvin has represented major broker dealers, as well as individuals, in more than 400 investment suits and arbitrations before FINRA, the NASD and NYSE. These have involved investment strategies in stocks, bonds, options, futures, insurance products, auction rate and mortgage-backed securities and derivatives, and have covered a broad range of compliance issues under federal and state securities laws and regulations. He also represents professionals in contract negotiations, employment suits and Texas Securities Board, FINRA and SEC regulatory proceedings. In 2007 and from 2009 through 2022, Mr. Harvin was named by his peers as a “Texas Super Lawyer†(a Thomson Reuters service) in securities litigation, having more than 60 cases tried to a decision or reported.
