Felony 2
Felony 2 crimes are serious offenses that carry harsh penalties. Though the elements of a felony 2 crime and its punishments may be slightly different depending on the state in which the crime takes place, the crimes and penalties listed below present a fair representation of the law and will provide a basic understanding of felony 2 crimes.
Felony 2 Crimes
Any person who attempts a crime that is punishable by death is guilty of felony 2.
First degree murder is classified as felony 2 if a person murders someone by –
- Lying in wait
- Poison
- Imprisonment
- Starving
- Or if a person dies during the commission, or attempt of, arson, forcible sodomy, robbery, burglary, abduction or sexual penetration with an object
Felony 2 Crimes Other Than Murder
- The premeditated, malicious, willful killing of the fetus of another
- Committing or conspiring or aiding an act of terrorism, or anyone who intends to commit a terroristic act and possesses, uses, gives, sells, distributes or manufacturers a weapon of terrorism
- Abduction of any person with intent to extort money, while intending to defile the person, or if the victim is a minor under 16 for the purpose of prostitution or concubinage
- Maliciously causes bodily injury to another with the intent to maim, disfigure, disable or kill, if the victim is severely injured, and suffered permanent and significant physical impairment
- Maliciously causes bodily injury to another with the intent to maim, disfigure, disable or kill, if the victim suffers the termination of a pregnancy
- Burgling a dwelling during the night with intent to commit a felony while armed with a deadly weapon
- Entering a dwelling and hiding with intent to commit murder, rape, robbery or arson, assault and battery while in possession of a deadly weapon
- Entering a dwelling and hiding with intent to commit a misdemeanor while in possession of a deadly weapon
- Committing larceny at a bank with a deadly weapon
- Possession or use of a machine gun or sawed-off shotgun or rifle while attempting/perpetrating a crime
- Treason
- Anyone who is punished by between 5 and 40 years with a fine of up to $1 million will be guilty of felony 2 for a second or subsequent offense and fined up to $2 million.
- Anyone who conceals, damages, falsifies, forges, or withholds personal knowledge of the revocation of the advance directive or Durable Do Not Resuscitate order of another and this action causes life-prolonging procedures to be withheld or withdrawn, and this action hastens death.
In Virginia, the presumptive sentence for felony 2 crimes is not less than 5 years and not more than 40 years imprisonment.
