- FraudAs long as the taxpayer has an outstanding tax liability, penalties and interest will continue to accrue even when an agreement for repayment is in place. Generally, there are two types of penalties: the Failure to File Penalty and the Failure to Pay Penalty. The Failure to File Penalty adds five percent of the total tax debt every month a taxpayer fails to file his/her return up to 25 percent. The Failure to Pay Penalty adds an additional 0.5 percent of the total tax debt every month, up to the maximum of 25 percent, until the tax debt is paid. In addition, taxpayers who significantly understate their tax liability on their tax return may be charged an additional 20 percent penalty. Taxpayers also risk facing civil penalties if the IRS suspects tax fraud. Executives and employees in corporations may be personally assessed civil penalties by the IRS for failing to pay payroll taxes.
