- Unfair CompetitionComputer Workstations, Inc. filed suit against Advance Ware, Inc., its principal, and an employee, alleging unfair competition, breach of contracts, interference with contracts, and trade secret violations. Mr. McCurdy was General Counsel for Advance Ware, Inc., and successfully defended the suit to settlement benefiting Advance Ware, Inc.
- Wrongful TerminationSeparate from federal statutory discrimination and retaliation claims, Colorado state law recognizes certain “wrongful discharge in violation of public policy” claims (e.g., discharging an employee for filing a claim for workmen’s compensation benefits). In some cases, the courts have evaluated whether a “constructive discharge” may satisfy the termination element of such claims. Proving that the employer terminated the employee generally is less problematic than the employee proving that he or she had no choice but to quit (constructive discharge).
- Employment DiscriminationWe also handle federal claims under the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Fair Labor Standards Act, and most other federal employment laws.
- Severance AgreementA company’s initial offer in a SA is usually not its final or best offer. SAs are usually negotiable, including the amount of severance pay the employee is to receive. If the employee has a potential legal claim, the company may pay additional money in exchange for the release/waiver of claims.
- Sexual HarassmentWe handle federal claims for discrimination and retaliation under Title VII of the Civil Rights Act, including claims for sexual harassment, hostile working environment, gender discrimination, equal pay, pregnancy discrimination, and discrimination based upon race, religion, national origin, or color.
