- Child SupportNondischargeable Debts - Debts That Cannot Be Eliminated While a significant amount of your debt can be discharged in a Chapter 7 bankruptcy, there are certain debts that cannot be eliminated. Child support arrearages, spousal support obligations, student loans and recent unpaid taxes are examples of some debts that cannot be discharged in bankruptcy. Liability resulting from a car accident caused by your drunk driving and liability for felony crimes also cannot be discharged.

Mr. Naziri has been practicing family law since 2001, including divorce proceedings, child custody and visitation issues, restraining orders, and litigation of family law matters. - Spousal SupportDistribution of community property is more straightforward if the bankruptcy is completed first. Once the bankruptcy is completed, there is a clearer picture of what assets remain (if any assets were liquidated). A common concern in divorce is what to do with the house. In cases where there is no equity in the home, surrendering the home in bankruptcy allows the couple to eliminate mortgage obligations and avoid the need to sell a house that has an " upside-down mortgage." Depending on the situation, the vehicle or other secured assets may be surrendered in order to eliminate debt obligations. Many people think they will benefit from filing for bankruptcy after divorce because they want to discharge child and spousal support obligations. However, child and spousal support obligations cannot be discharged in bankruptcy.
