If you die without a Will the State of Tennessee mandates how your property will be distributed, regardless of your wishes. Your Last Will and Testament is your opportunity to distribute your property, create testamentary trusts, provide for the care of your minor children, name your Trustee and your Executor, and otherwise express your desires upon your death. We have helped hundreds of Tennesseans with their estate planning needs, large and small.Your estate planning needs may change as your life changes. It is common for people to update their Wills throughout their lives. Even if we did not draft your original Will, we can draft a Codicil (change to an existing Will) or a new Will that addresses changes in your financial situation, marital status, number of children, philanthropic interest, and general lifestyle decisions.Estate planning is more than Wills and Trusts. Estate planning includes matters that apply during your lifetime. The proper estate plan may include a Durable Power of Attorney for Health Care, a Durable Power of Attorney for Financial Matters, and/or a Living Will. These documents allow you to name persons to make decisions on your behalf if you are unable to do so. Making these decisions yourself, in advance, may help take the burden off your loved ones. We always discuss these documents with our clients as part of the estate planning process.
