Hiring a lawyer is important if you have been arrested. You may also need to hire a lawyer if you want to sue someone or if you have been sued. However, you'll want to make sure you get the best lawyer for your situation. Read on for the top 10 questions to ask before hiring a lawyer.

  1. What type of law do you specialize in? Now all lawyers do all things. Criminal lawyers are different from those who file lawsuits or who defend against private lawsuits. Make sure you find out exactly what your lawyers specialty is before you hire him
  2. How long have you been practicing? Some new lawyers may be creative, excellent and dedicated attorneys. However, you may want a more seasoned veteran to help you out with your legal troubles. Someone who has years of experience may have a better understanding of how to help.
  3. How often do you go to court? Most cases settle out-of-court before litigation begins. Thus, many attorneys work almost exclusively outside of a court room. If you believe your case is likely to end up being settled in an actual trial instead of in negotiations before the trial begins, you'll want to ensure your lawyer has sufficient experience representing clients in an actual court room.
  4. Do you belong to any professional organizations? While not all lawyers do, if your attorney either belongs to a professional organization or writes articles for law journals or does some other activity within his specialty, this can show that he is truly dedicated to what he does and passionate about the type of law he practices. Someone who is passionate is a good person to have on your side.
  5. Will you be handling my case yourself? This is especially important in a large law firm. If you hire someone high up in the firm- a partner, perhaps- then he may outsource some of the work on your case to associate (lower ranked) attorneys or even paralegals. Find out exactly who will be representing you.
  6. How do you charge? Some lawyers charge on a contingent fee basis- which means they only get paid if you win. Others charge an hourly fee regardless of whether you win or lose. If you cannot afford to pay unless you win, then you will need a lawyer who is willing to work on contingency.
  7. How much do you charge? It is common for lawyers who work on a contingency fee basis to charge a percentage- often 30 percent- of the amount that you obtain as a verdict. Lawyers who charge on an hourly basis, on the other hand, can charge several hundred dollars per hour.
  8. What retainer do I need to give you? This is the amount of money you have to pay when you hire the lawyer to represent you. It is usually a lump sum, which is then used to pay the attorney's fees as he does the work for you over time. Make sure you find out how much this is and that you have that much cash to spend now.
  9. What other fees and costs can I expect? You may need to hire expert witnesses, investigators, forensic accountants or a whole host of other professionals to help you win your case. Find out approximately how much that will all cost.
  10. What is your track record of successful wins? While every case or situation is different and past performance won't necessarily guarantee the same results for you, you still want to opt for an attorney who tends to win more than he loses.
