What are Personal Injury Civil Lawsuits?

Under the United States legal code, a civil lawsuit is a civil action in which a plaintiff seeks a legal resolution to a complaint. Civil lawsuits almost always involve conflicts between citizens and hardly ever involve government agencies or personnel, except in states where the government may be sued as a private party.

The lawsuit is heard in court, and if the plaintiff wins the case, the judge will award damages, impose a penalty on the defendant, enforce the plaintiff's right, or issue an injunction to stop illegal behavior. The judge may impose a combination of these conditions as well. If you or someone you know has been injured and another party is to blame, you should consider contacting a personal injury attorney to discuss filing a civil lawsuit.

In the type of civil lawsuit known as tort law, or a personal injury lawsuit, a personal injury attorney will fight for the plaintiff to be awarded damages. These damages, usually money but sometimes other services, are paid to the plaintiff by the defendant, and are intended to repay lost wages, assist with medical expenses and make up for pain and suffering.

Personal injury lawsuits cover a lot f ground, but the most common lawsuits involve automobile accidents, on the job injuries, negligent health care, medical malpractice, defective products, exposure to hazardous substances and dangerous or poorly maintained buildings and grounds.

Before filing a lawsuit, you must first discuss your case in detail with your personal injury attorney. A good personal injury attorney will do comprehensive research to be sure that your case has legal standing and that you are still within the statute of limitations.

Before going to trial, your personal injury attorney should have a detailed plan of attack and significant proof of both the extent of your injury and the fault or negligence of the defendant. If you do not win your case, or if you are awarded some damages but you think that you deserve more, your personal injury attorney can file an appeal with an appellate court.

The appeal court may rule differently, or may award you more damages, but be aware that they can also dismissed the case, uphold the decision of the lower court, or even call for a new trial. Lawsuits can be long and arduous, but if you were significantly injured by someone else's negligence or ill will, you deserve justice.
