Felony 3 crimes are slightly less serious offenses that carry stiff penalties. Though the elements of a felony 3 crime and its punishments may be slightly different depending on the state in which the crime takes place.

Felony 3 Crimes

The following are generally considered felony 3 crimes -

  • Conspiring to commit a crime which is punished with the death penalty
  • Causing bodily harm to another, while part of a mob, with the intent to maim, disable, disfigure or kill
  • Causing bodily harm to another with the intent to maim, disable, disfigure or kill
  • Committing 3 felony crimes at different times over period of 10 years
  • Committing or aiding and abetting the commission of an act of terrorism if the base penalty is a prison or jail term of less than 20 years
  • Using, possessing, selling, giving, distributing or manufacturing an imitation of weapon of terrorism
  • Abducting or taking a person hostage as a prison escapee
  • Using poison in any way as a means to injure or kill another
  • Breaking and entering a dwelling of another at night with intent to commit a felony
  • Entering a dwelling and hiding with the intent to commit murder, rape, burglary, robbery or arson
  • Using a computer or computer network to cause physical injury to a person
  • Committing unnatural acts with grandchild or child under the age of 18, but who is at least 13
  • Committing adultery or fornication with a child or grandchild who is over 13 but under 18
  • Abusing or neglecting an incapacitated adult and the abuse or neglect results in death

Felony 3 Penalties and Punishments

Felony 3 crimes are punished by a term of imprisonment of not less than 5 years, and not more than 20 years and a fine of up to $100,000

Repeat offenders and those who have mitigating or aggravating circumstances can expect different terms of imprisonment, while those who commit crimes based on hate will often be penalized with sentence enhancements.
