- AnnulmentNew Hampshire RSA 651:5 enables certain criminal arrests and convictions to be removed from the state and FBI criminal history record. The process begins by filing a Petition to Annul with the court of jurisdiction. There are required fees to the annulment process, specifically, a court filing fee of $100.00, a Department of Corrections Parole and Probation report fee of $100.00, and a state police administrative fee of $100.00 to remove the annulled CHRI from both the state and FBI criminal history. You will want to start by getting a copy of your criminal record which will cost $25, the link to do that is below.
- Criminal DefenseYour case is unique, no two cases are the same. The results an experienced criminal defense attorney can obtain for you may hinge on minor facts you deem not relevant. The following is just an overview of the law, but it is critical to get fact-specific advise as quickly as possible.
- DUI/DWIIn addition to the court's sentence in a DWI case, the New Hampshire DMV may take administrative action to suspend your license or impose requirements before your license is reinstated. This is often referred to as the administrative license suspension or "ALS." An administrative suspension may be longer than the loss of license ordered by the court, and, in the case of a refusal, will be consecutive to any court-ordered loss of license.
- Traffic ViolationsIf you are convicted of 3 major motor vehicle offenses within a 5 year span, you can be certified as a habitual offender and lose your license for up to 4 years. DWI is a major offense as are Operating After Suspension, Reckless Driving, Conduct After an Accident, Disobeying a Police Officer and Taking Without the Owner’s Consent. You can also be certified for a combination of major and minor offenses such as speeding. If your driving record contains more than five minor convictions or 2 major convictions you should be concerned about this law. If you are caught driving after certified as a habitual offender you could be sentenced to one year in jail.
- Theft
- MisdemeanorsA trial is when your case is scheduled to have the facts presented to and decided by either a judge or, in the case of a class "A" misdemeanor or felony level offense, a jury. The judge or jury determines what facts have been proven beyond a reasoanble doubt in a criminal case, by a probability in a civil case, and they are then instructed on what laws apply to your case. By applying the law to the facts a verdict is reached.

- WillsBefore you get on-line and read every article about DWI/OUI (the terms are the same) you can find, or call your brother in California who once got a DWI years ago, pause. Contact a trusted friend who lives in the area, who do they go to for advise? The lawyers who specialize in wills and trust, corporate law or real-estate, who do they use or recommend? (run away if they tell you to use there "new crackerjack" associate who is "really interested" in criminal defense) Do you know any court staff or law-enforcement in the area for a recommendation? These are the paths most take in finding this office and one that is based on experience and competence, not a flashy website or telling prospective clients only what they want to hear.
