Divorce Mediation: Ending a marriage is always painful, but the divorce process should not worsen the situation. By using my mediation services instead of hiring lawyers for litigation, you avoid the delays, excessive legal bills, and trauma that results from the traditional adversarial court process. Most importantly, you protect your family from the turmoil and divisiveness wrought by litigation. I will sit down with you and your spouse to help you resolve all issues: child custody, child support, parenting time, property and debt division and spousal support. My role is as a neutral party, guiding the discussions and helping you stay focused and rational, providing a setting in which you can identify options and find solutions best suited to your situation. As you reach agreements, I draft a document detailing the agreements. You both review the document with me to ensure you approve every word, and neither of you will sign the agreement until each of you has had ample opportunity for repeated reviews on your own and if you choose, with a third party, such as a lawyer or a financial adviser or both To become divorced, a court must enter a Judgment of Divorce that incorporates this agreement. While I will not represent you in court, I will help you understand the court process and the required court documents. Since you will have resolved all conflict, the divorce court process becomes a matter of paperwork instead of an adversarial process, so the whole process is a peaceful one. Divorce mediation still feels like a new idea in Michigan, but it is well known and widely accepted in many other parts of the country and has actually been used for decades. Mediation is the smart approach to divorce. Most divorces- approximately 95%- do not go to trial, they end in settlement. Under the traditional system, however, couples spend thousands of dollars on separate attorneys, battling their positions for months before reaching a settlement often pushed on them by the attorneys or forced on them by the judge. The sensible approach is to start out in settlement discussions, with you making the decisions for yourself about your children and your property.
